The Environmental Prosecutor's Office has proposed to the Madrid City Council to criminally prosecute drivers of polluting vehicles on traffic restriction days. This is what has emerged from a letter dated January 9 that was known this Tuesday. "It is proposed, from the institution that I direct, that on the days when traffic restrictions are decreed, police traffic control patrols be organized and criminal action be taken against those drivers or users of highly polluting vehicles," details prosecutor Antonio Vercher Noguera, from the Environmental Prosecutor's Office. The letter is sent directly to the mayor of Madrid, José Luis Martínez-Almeida. The prosecutor relies on article 325 of the Penal Code, "which allows a broader approach to be applied when prosecuting such alleged criminal offenses after the 2015 reform.
Specifically, this article of the Penal Code punishes with prison, fines or disqualification those who "directly or indirectly cause or carry out emissions, discharges, radiation, extractions (...)" that contravene "the laws or other Pakistan WhatsApp Number general provisions protecting the environment". A week ago, the corporation chaired by Mayor Martínez-Almeida activated the anti-pollution protocol after high levels of nitrogen dioxide and an unfavorable weather forecast were detected.
As the newspaper El País reported , this scenario meant that vehicles could only travel at a maximum speed of 70 kilometers per hour on the M-30 and on the interior access roads of the M-40 from 6:00 a.m. The document, which you can consult here, also details the possible collaboration between the Municipal Police and SEPRONA agents of the Civil Guard or traffic police, if necessary. It also proposes that there be a Municipal Police coordinator at the Prosecutor's Office headquarters to expedite the reception and processing of the reports. After the service was announced this Tuesday by other media outlets, the Madrid councilor himself has admitted to the media that he is willing to "reflect" on the proposal.
